§1 Rules for making a Booking and using the Website
- A Booking of the Property can only be made by an adult natural person or an entity with full legal capacity.
- Making a Booking means reading and accepting the Gaia-Mazury Terms and Conditions.
- The Offer presented on the website constitutes the basis for concluding an Agreement, in accordance with Art. 71 of the Civil Code.
- When making a Booking, the Website User is obliged to select:
- Booking dates
- Minimum booking is a 3-night stay (May–September season)
- Minimum booking is a 2-night stay (October–April season)
- Number of participants
- The Booking is confirmed by sending an e-mail to the User containing confirmation of data and payment instructions.
- After paying for the booking, the Agreement is binding on both parties on the terms specified in the Booking and the Terms and Conditions.
- In the event of withdrawal from the agreement by the User more than 30 days before its implementation date, the Host cancels the provisions contained in the agreement and makes the booking dates available for further sale. The entire amount is refunded to the User.
- Cancellation of the agreement by the User less than 30 days before its implementation date entails the loss of payment to the Host.
- The Agreement for the stay is concluded for the period indicated in the Booking. It can be extended during the stay if the Host confirms the availability of a given date.
- The User may shorten their stay. The Host is not obliged to refund funds for a shortened stay.
§2 Rules of Stay in the Cabin and using the Property
- The User is obliged to use the Cabin and the Property on the terms set out in the following regulations.
- The purpose of the Cabin and the Property is defined as tourist and recreational.
- The stay begins at 4:00 PM on the day of arrival and ends at 11:00 AM, with the possibility of extension, after prior contact with the Host.
- Quiet hours apply from 10:00 PM to 7:00 AM the next day.
- It is in the User's interest to check the condition of the Cabin and the Property for any damage and missing equipment (Appendix 1 and 2) and report them immediately to the Host. If the User finds irregularities and does not report them to the Host on the day of check-in, the Host has the right to charge the User with financial responsibility for unreported damage or missing equipment.
- The Host inspects the condition and equipment of the Cabin and the Property on the day of check-out, in the presence of the User, or makes a video review of any damage, when the User has left the property during the Host's absence previously agreed by phone or email.
- If during the stay there are defects or damages on the Property or in the Cabin, the User should immediately inform the Host so that they can take steps to eliminate the irregularities.
- The User is obliged to return the Property in an undeteriorated condition (taking into account everyday wear and tear). The User is financially responsible for damages resulting from improper use of the Cabin or Property.
- Up to 5 people can sleep in the Cabin. If the Host finds that there is an unauthorized number of people on the Property, they have the right to terminate the Agreement or charge an additional fee.
- The User is obliged to leave the Cabin and the Property on the last day of the stay by 11:00 AM in the presence of the Host, who will carry out an inspection and return the deposit. In the event of finding defects, irregularities, or missing equipment, the Host will charge a fee and deduct its equivalent from the deposit. If the fee for defects, irregularities, or missing equipment is higher than the amount of the deposit paid, the User is obliged to pay the surcharge in cash before leaving the Property.
- The User may not make any changes in the Cabin or on the Property.
- There are private parking spaces on the Property, included in the price of the stay. Parking is allowed only in designated areas. Driving a car on green areas is strictly prohibited.
- There is a sauna and a hot tub on the Property. Their use is included in the rental price, subject to the safety rules contained in § 3.
- Smoking is strictly prohibited in the cabins.
- Adult guardians are obliged to provide 24-hour care for minor children staying on the Property and in the Cabin. They bear full responsibility for minors.
- Losing the keys to the Cabin will result in charging the User with the total cost of replacing all external locks.
- It is possible to rent the Cabin to organize intimate and quiet events such as: bachelorette party, baby shower, birthday - with the prior consent of the Host. If the User organizes a social gathering without the Host's consent, the Host has the right to terminate the agreement during its execution, without the possibility of refunding the costs incurred by the User. Additionally, they may charge the User with the cost of extra cleaning if necessary.
- Waste segregation into designated containers is obligatory in the cabins and on the property.
- Staying in the Cabin with a dog is possible under the following conditions:
- a) Prior notification of the stay with a dog, taking into account the size and breed – the Host has the right to refuse if the dog breed is considered aggressive,
- b) Having a valid dog health book and current mandatory vaccinations,
- c) The User is financially responsible for any damages caused by the dog, but above all, should prevent them,
- d) The dog should not be an obstacle to the rest of other Users and residents of neighboring houses by making excessive noise, destroying the Property area, or violating the boundaries of residential properties located nearby,
- e) The dog can stay in the Cabin and on the fenced Property belonging to the cabin without a leash. Outside the fenced property area, in common areas, the owner is obliged to use a leash. The leash is provided by the pet owner,
- f) The User is obliged to clean up after their dog. If the Host finds a violation of this point of the Regulations, they may charge an additional cleaning fee of PLN 100,
- g) The User bears full legal and statutory responsibility for the dog's behavior and the resulting consequences,
- h) In the event that the dog destroys property and/or grossly disrupts the stay of other Users and local Residents, the Host has the right to terminate the rental agreement with immediate effect.
§3 Safety rules
- The User agrees to comply with the Safety Rules, which are made available on the website, by e-mail, and in writing in the Cabin.
- a) The mezzanine in the Cabin can be used by adults. Minors can be brought up the stairs under the strict supervision of a guardian. The Host is not responsible for improper use of the mezzanine that is inconsistent with the regulations. Special care should be taken when moving on the stairs.
- b) One adult weighing up to 80 kg plus a child weighing 30 kg or two children can stay on the mezzanine net at a time. Under no circumstances should you jump on the net.
- c) There is a designated bonfire area on the Property, and this is the only area where it is allowed. Lighting a bonfire in other places is strictly forbidden, and if the Host finds such a circumstance, they have the right to impose a financial penalty on the User and/or terminate the agreement.
- d) The equipment of the Cabin and Property is made available for use exclusively for its intended purpose and on its premises.
- e) The User may not use their own heat sources and equipment for preparing meals.
- Appendices 1 and 2 to these Regulations constitute a description of the rules for using the sauna and hot tub on the Property.
- The User is responsible for compliance with the above rules by all persons registered with them to stay on the Property. If the Host finds that the safety rules are broken by the User or persons accompanying them, the User bears full responsibility.
§4 Complaints
- Complaints regarding the scope of services provided, fulfillment or non-fulfillment of the Agreement by the Host can be sent directly to the Host via AlohaCamp.
- In the complaint, the User is obliged to indicate the reason for the complaint (to what extent the Host did not fulfill the conditions of the agreement, possible reason for dissatisfaction with the quality of services, etc.) and to indicate the complaint demands.
- The Host will consider the User's complaint within 14 days of its receipt.
- In case of refusal to accept the complaint, the Host is obliged to justify it.
- In the event of recognizing the User's complaint in whole or in part, the Host offers the following forms of compensation: refund of all or part of the fee for the stay, a discount voucher for the next stay.
§5 Termination of the Agreement
- The Cabin Stay Agreement expires on the last day of the stay at the time of check-out, no later than 11:00 AM (or another time agreed with the Host).
- In the event of finding gross violations or non-compliance with the Rules of staying in the Cabin and on the Property, the Host has the right to terminate the agreement with immediate effect, and the User is obliged to immediately return the keys and leave the Property.
- Termination will be made verbally and confirmed by e-mail correspondence. The stay fee is non-refundable.
§6 Liability of the Parties
- The User is responsible for the proper use of the Cabin and the Property during the stay of all persons indicated in the Booking.
- The User is responsible for any damage caused to the Cabin (including its equipment) or the Property resulting from their improper use, including their destruction or shortages.
- The Host is not responsible for money or valuables/material goods left in the Cabin or on the Property. They are also not responsible for damage, theft, or destruction of vehicles left on the Property.
- The Host is not responsible (to the extent permitted by applicable law) for any damages incurred by persons using the Cabin or the Property if they arose in connection with the improper use of the Property, Cabin, or their equipment, especially failure to comply with the safety rules indicated in § 3.
§7 End of Stay and handover of the Property
- On the day the stay ends, no later than 11:00 AM (unless agreed otherwise), the User is obliged to hand over the keys to the Host.
- The Cabin and Property should be handed over in an undeteriorated condition, allowing for normal wear and tear.
- The User should hand over the Cabin and Property after previously tidying it up. Tidying up includes collecting all garbage into the bin and washing the dishes.
- If cleaning the Cabin or tidying up the Property after the User's Stay requires extraordinary measures (dry cleaning, hiring a specialized cleaning crew), the Host may charge the User for the costs.
Appendix No. 1
Sauna rules
- Before using the sauna, the User is obliged to read the Regulations.
- While using the sauna, the User is obliged to comply with the regulations and the commands and instructions given by the Host.
- Only the Host may make any sauna adjustments.
- Sauna users are obliged to keep it clean and tidy.
- Only adults may use the sauna.
- Use of the sauna by minors is prohibited. If minors are allowed to use the sauna, the guardian bears full responsibility and must exercise strict control over the minor's safety.
- Parents or guardians of minors bear full responsibility for their actions and any damage resulting from these actions.
- Persons using the sauna declare their physical fitness to use it, i.e., health fitness, and are solely responsible for their health if they decide to use the sauna against medical advice or when they are unsure of their health condition.
- Do not touch the stove elements and watch out for any structural elements of the stove, as this may cause burns.
- Before using the sauna, get rid of any metal elements such as jewelry, etc. Do not use glasses and contact lenses.
- One session should not last more than 10-15 minutes. Then cool the body with cold water and wait 10-15 minutes before the next entry. It is recommended to perform 3 sessions for the best results.
- On the sauna premises, it is forbidden to:
- a) enter in clothing and footwear,
- b) perform cosmetic treatments,
- c) bring dishes, food, and any foreign objects,
- d) bring alcoholic beverages,
- e) smoke tobacco,
- f) destroy and damage equipment.
- It is forbidden to use the sauna under the influence of alcohol.
- After a sauna session, it is forbidden to use the hot tub; physical exertion is not recommended.
- In case of feeling unwell and any doubts about your health, immediately leave the sauna.
- Contraindications for using the sauna:
- a) skin diseases
- b) menstruation
- c) pregnancy
- d) diabetes
- e) hyperthyroidism
- f) acute rheumatic states
- g) upper respiratory tract infections: cold, flu, acute asthmatic state
- h) fever
- i) heart and cardiovascular diseases
- j) acute inflammations
- k) active stomach and duodenal ulcer disease
- l) kidney stones
- m) foci of infection (e.g., with a toothache)
- n) diseases of the central nervous system
- o) alcohol and drug abuse
- p) the first month after surgery or treatment
- q) people with implants, e.g., hip endoprosthesis
- r) diseases: venereal, neoplastic, epilepsy, glaucoma, color blindness (consultation with a doctor is recommended).
- Using the sauna is at your own risk.
- Any irregularities in the functioning of the sauna should be immediately reported to the staff, and its use should be stopped until the irregularities are removed.
- Persons not complying with the regulations may be removed from the sauna.
- Entering the sauna is tantamount to reading and accepting the regulations.
- In the event of an accident caused by non-compliance with the regulations, the Host is not liable.
Appendix No. 2
Hot tub / jacuzzi rules
- Before using the hot tub, the User is obliged to read the Regulations.
- While using the hot tub, the User is obliged to comply with the regulations and the commands and instructions given by the Host.
- Only the Host may make any hot tub adjustments.
- Water is poured into the hot tub by the Host or the User with prior consent and instructions from the Host.
- Under no circumstances should the hydromassage pumps and flow filters be turned on before the Hot Tub is completely filled.
- In winter, the hydromassage pumps and flow filter can only be started when the Hot Tub is filled with water and reaches a minimum temperature of 30°C.
- Persons using the hot tub declare their physical fitness to use it, i.e., health fitness, and are solely responsible for their health if they decide to use the hot tub against medical advice or when they are unsure of their health condition.
- Persons with cardiovascular, respiratory, neurological, and gastric dysfunctions, as well as pregnant women, should use the hot tub with extreme caution and after consulting a doctor.
- Before entering the hot tub, wash your body using a cleansing agent.
- Persons with infectious diseases, visible dermatological conditions, and wounds are strictly forbidden from using the hot tub.
- Minors may only use the hot tub under the strict control of guardians. The guardian bears full responsibility for the health, life, and safety of minors.
- Do not use the hot tub under the influence of alcohol or drugs.
- The hot tub is designed for a maximum of 6 people. An excessive number of people is prohibited.
- In the event of an accident caused by non-compliance with the regulations, the Host is not liable.
- Any irregularities in the functioning of the tub should be immediately reported to the staff, and its use should be stopped until the irregularities are removed.
- Persons staying in the tub are forbidden to:
- a) Cause potentially dangerous situations,
- b) Use the hot tub when it is out of service,
- c) Throw other users into the water,
- d) Add any chemicals to the water other than those provided by the Host and available in the cabin for the Host's disposal,
- e) Submerge head and face,
- f) Manipulate structural elements,
- g) Draining water takes place into the sewage drain located next to the Hot Tub using a specially prepared garden hose,
- h) After draining the water, the Hot Tub must be washed before refilling,
- i) Using the Hot Tub without water treatment chemicals can take place for a maximum of 4 days. After this period, special water treatment agents located in the cabin must be used.
- Contraindications:
- a) ischemic heart disease
- b) hypertension
- c) diabetes
- d) allergies
- e) skin inflammations
- f) urinary tract infections
- g) mycosis
- h) epilepsy
- Using the hot tub is entirely at your own risk.
- Persons not complying with the regulations may be removed from the hot tub.
- Entering the hot tub is tantamount to reading and accepting the regulations.
- In the event of an accident caused by non-compliance with the regulations, the Host is not liable.
Appendix No. 3
Rules for using the lake shoreline and pier
- Thanks to the courtesy of the Owners of the plot adjacent to the lake, Guests use the passage to the shoreline and pier.
- The use of the pier and water equipment should be done in a way that does not disturb the privacy of the plot Owners.
- The pier is also used by everyone from the immediate vicinity of Gaia. Please respect and take into account the presence of other residents and co-users on the footbridge.
- We do not lay out blankets, towels, and sun loungers on the grass near the pier,
- We do not leave any garbage behind,
- Pets can only be present under the strict care of their owners,
- We clean up after our pets.
